GENERAL TERMS OF SALES

1- USE
This website ("BAOT TRIP") belongs to SAS BOAT TRIP, which operates it for your personal use and information. Your use of BOAT TRIP is subject to the general terms of use set forth on the following page.

 

2- PERSONAL INFORMATION
BAOT TRIP's Privacy Policy found on this page is part of these T&Cs, and you agree that the use of information as described in said Policy does not violate your publicity and privacy rights.

 

3- ACTIVITY PRICES
The prices for each activity are presented per outing and include all taxes.

Prices do not include gratuities, individual insurance and meals unless expressly mentioned on the activity detail page.

 

4- PAYMENTS ON THE SITE
The processing of credit cards on BAOT TRIP is done by Stripe on behalf of BAOT TRIP. Stripe accepts payments made by Mastercard, Visa and American Express. Stripe's security level is one of the highest in the Internet banking market. Stripe is a PCI Level 1 certified service provider. 

Data is secure and encrypted, at no time does Stripe or BAOT TRIP have access to these numbers. For more information on this platform please visit their website at https://stripe.com/fr

You will not be charged any fees or commissions when you make transactions on BAOT TRIP in exchange for using Stripe.

The payment made on BAOT TRIP is a portion of the price of the chosen activity and will appear as BAOT TRIP on your credit card statement. The balance to be paid is usually requested by the provider on the day of your activity, but the provider may request that the balance be paid x number of days before your activity date. If applicable, the balance payment will be indicated on your reservation receipt. You will usually be notified by text and/or email of the balance due when it becomes due to the provider. Any late payment of the balance may result in the cancellation of your reservation by the Provider.

 

5- VALIDATION AND CONFIRMATION OF YOUR RESERVATION
The validation step of the reservation only allows you to check that the boat is still available at the time of your reservation. The boat will be definitively blocked at the moment of your online payment. Therefore, the confirmation of your reservation will be effective only from the moment you have made your deposit.

 

6- MODIFICATION OF A RESERVATION
You can modify your reservation free of charge up to six (6) days before your activity by clicking on the link in the confirmation email of your activity. Within six (6) days of the start of your activity, the modification fees will either be indicated on your reservation ticket, or, if applicable, will be the same as those applicable in the case of cancellation under the terms of the following article of these T&C ("CANCELLATION OF A RESERVATION").

Reservations cannot be changed within 48 hours of the scheduled departure date.

Changes of dates will be validated subject to the availability of the activity on the desired dates.

Modification of an activity that was priced based on a special promotional offer may result in the cancellation of the special offer discount granted in the initial reservation.

If one of our providers changes the dates and/or conditions of one or more of its activities, BAOT TRIP reserves the right to cancel, replace or modify your reservation accordingly. In the event of such a modification, and if this modification is not to your satisfaction, you will be entitled to request a full refund of the deposit made at the time of your reservation for the modified activity. Any modification made by BAOT TRIP will be done in consultation with the provider, yourself and possibly alternative providers to find the best modification to make.

 

7- CANCELLATION OF A RESERVATION
Cancellation of a reservation may result in a cancellation fee by BAOT TRIP as described below which cannot exceed the amount of your reservation deposit:

If your cancellation is submitted at least six (6) calendar days prior to the scheduled departure or start time, no cancellation fee will be charged.
If your cancellation is made less than forty-eight (48) hours prior to the scheduled departure or start time of the activity, your deposit will be cashed at 100%.
If your cancellation is presented between two (2) and six (6) days before the scheduled departure or start time of the activity, a cancellation fee of 50% to 100% of your deposit will be charged according to the percentages indicated on your reservation ticket.
Some providers may have their own rules regarding cancellation periods that override the terms hereof. If the provider's rules are different, they will be indicated during your booking process in the "Cancellation Policy" box. If the provider's cancellation policy is not acceptable to you, you may not make the reservation by not checking the "I accept the above terms and policies" box at the end of the reservation process. By booking on the website or by phone you agree to the terms and conditions and the cancellation policy indicated on your booking ticket.

 

8- RESERVATION RECEIPT
A reservation receipt to be printed will be provided to you upon payment of your reservation. This receipt contains the details of your reservation with a unique identification number that may be requested by the provider. Please present yourself to the provider with an ID to identify yourself and avoid fraud.

 

9- CUSTOMER ACCOUNT
By booking an activity you automatically open an account with our technology provider Bookeo. Bookeo manages the content of the reservation and its modifications.

The bookeo account allows you to modify or cancel your reservation without releasing you from your obligations and costs inherent to the modification or cancellation of a reservation outside of the prescribed deadlines.

After you have completed your activity you can request that we delete your customer account from the Bookeo database. To make your request, simply send us an email to marinarentals971@gmail.com using the email you used to make the reservation along with your first and last name.

Notwithstanding the above, BAOT TRIP can, at any time, modify, temporarily or permanently interrupt access to all or part of your Bookeo account, for any reason and without prior notice.

 

10- LIMITATION OF LIABILITY
NEITHER THE OWNER OF BAOT TRIP, NOR ITS LICENSORS, OFFICERS, DIRECTORS, AGENTS, AFFILIATES, EMPLOYEES, SUCCESSORS AND ASSIGNS SHALL BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL, ARISING OUT OF THE PERFORMANCE OR NON-PERFORMANCE OF THE SERVICE, WHETHER SUCH DAMAGES ARE BASED ON CONTRACTUAL OR NON-CONTRACTUAL LIABILITY, AND THEY SHALL NOT BE OBLIGATED TO INDEMNIFY YOU OR ANY THIRD PARTY.

In no event shall BAOT TRIP, its licensors, officers, directors, agents, affiliates, employees, successors and assigns be liable for any damages or losses, either direct or indirect, resulting from force majeure or any cause reasonably beyond their control, including, without limiting the generality of the foregoing, the successful completion of a tour or the inability to complete a tour.

 

11- AUTONOMY OF PROVISIONS
In the event that any provision of these T&Cs is invalidated, in whole or in part, by a decision of a court of competent jurisdiction, such provision or the part so invalidated shall be ineffective in such jurisdiction, without affecting the remaining provisions of these T&Cs or their validity in any other jurisdiction.

 

12- INTERPRETATION
The sections and headings of these GTC are for guidance only and shall not affect the interpretation of these GTC.

In these GTC, the singular includes the plural and vice versa, and the masculine includes the feminine. Words denoting persons include individuals, sole proprietors, partnerships, corporations, trusts and unincorporated associations.

 

13- APPLICABLE LAWS
This Site is controlled and operated by BAOT TRIP from Montreal, Province of Quebec, and these T&Cs are governed by the laws of the Province of Quebec and the applicable laws of Canada, without reference to principles of conflict of laws. You agree to be bound by such laws and to submit to the jurisdiction of the courts of the Province of Quebec with respect to the interpretation or application of these T&Cs.

 

14- ENTIRE AGREEMENT & WAIVER
These T&Cs and any other legal notices appearing on this Site constitute the entire agreement between you and BAOT TRIP and govern your use of the Site and the materials and services contained herein.

BAOT TRIP's failure to exercise any rights under these TOS shall not constitute a waiver of such rights. No waiver of any provision of these GTCs shall be binding and effective against BAOT TRIP unless such waiver is in writing and signed by BAOT TRIP. No waiver of any provision of these T&Cs shall constitute a waiver of any other provision and no such waiver shall constitute a continuing waiver unless expressly provided.

  

15- MODIFICATIONS TO THE TERMS AND CONDITIONS
BAOT TRIP may modify or otherwise update the applicable T&Cs from time to time, without notice, and you agree to be bound by the terms and conditions that are in effect at the time you make a reservation on BAOT TRIP or over the telephone through one of its agents.
